At The Agency Sales & Lettings, we are fully compliant with the Tenant Fees Act 2019, which regulates what landlords and letting agents are permitted to charge Tenants in England. Below is a clear breakdown of the permitted fees you may be required to make.
Holding Deposit of One weeks’ rent
A holding deposit of one weeks’ rent will be requested to reserve a property. This is capped at no more than one weeks’ rent and on successful completion of all pre tenancy checks, will be put towards your first months’ rent. This will be non refundable should you withdraw your application for the property, fail in the referencing process or provide false or misleading information which results in the tenancy being withdrawn.
Security Deposit of Five weeks’ rent
The security deposit is capped at five weeks’ rent (where annual rent is under £50,000) or 6 weeks’ rent where the total annual rent is £50,000 or above.
This deposit is held to cover any damage or breaches of the tenancy agreement and will be protected in a government approved tenancy deposit scheme.
The Agency Sales & Lettings also partners with Reposit low deposit scheme, which provides an alternative low deposit scheme whereby the tenant pays a payment directly to Reposit which is the equivalent of one week’s rent, which is none refundable. This deposit scheme must be agreed with the landlord and not available on all properties.
Unpaid Rent
If rent is overdue, the landlord is legally entitled to charge interest at 3% above the Bank of England base rate from the rent due date until payment is made.
- Interest will only be applied once the rent is more than 14 days in arrears, backdated to the date the rent first became due.
- This charge is applied in line with the Bank of England base rate at the time.
Lost Keys, Lost Security Device or Lost/Defaced Parking Permits
Tenants are liable for the actual cost of replacing all lost keys and other security devices such as building access fobs and car park fobs, including the loss or defacement of parking permits.
If a key, fob, or other security device is lost, the tenant will be charged to cover the cost of replacements and associated arrangements. Additional costs may apply if replacement keys and fobs exceeds this amount (evidence of costs will be provided). If the loss results in a locksmith being required the cost of a locksmith, locks and replacement keys will be the responsibility of the tenant. The Agency will charge £15 per hour including VAT for their time.
Variation of Contract when requested by Tenant
If you request a reasonable change to your tenancy agreement which is approved by your landlord a charge of £50 will apply to cover associated costs.
Changes of Sharer when requested by Tenant
Where a tenant requests to change a sharer within a joint tenancy, a £50 fee will apply for referencing, Right to Rent checks, and contract amendments. In the event the change is complex in nature, we reserve the right to charge in excess of £50 and this will be agreed with the tenants in advance. All requests are subject to approval by the landlord.
Early Termination when requested by Tenant prior to Renters Rights Act
If you request to leave the tenancy before the end of the fixed term, you will be liable for:
- The landlord’s reasonable costs in re-letting the property
- Rent due until a new tenancy commences
Costs will not exceed the financial loss suffered by the landlord and will be confirmed in writing. If agreed the current fee is £200 + VAT.
Early Termination when requested by Tenant post Renters Rights Act 1st May 2026
Post Renters Rights Act coming into force 1 st May 2026, tenants will be able to give 8 weeks notice to end their rolling tenancy at any point. Should a tenant wish to end their tenancy early ie not be able to wait for the 8 weeks notice period, the early termination fee will still be payable, refundable if The Agency are not successful in re-letting the property any earlier than the original 8 weeks notice period.
Referral Fees
The Agency, may receive income from tenant service introduction such as contents insurance/utility introduction. Tenants are free to choose their own suppliers by opting out.
